Article 1 - Definitions


1.1 The following terms are used in these general terms and conditions:

- "Tatsushin": Tatsushin, located at Galvaniweg 22, 8071SC in Nunspeet, telephone number 06-22763285, Chamber of Commerce number: 55954707, Branch number: 000025557505.

- "Member": a person who wants to take out or has taken out a membership with Tatsushin.

- "Client": a person or organization that purchases a personal training, PMT, workshop or other service.


Article 2 - General


2.1 Every athlete is obliged to be aware of Tatsushin's general terms and conditions. These conditions are provided and accepted online upon first registration via Eversports and can be downloaded from the website www.tatsushin.nl. If there is an agreement between Tatsushin and the athlete, these general terms and conditions form an integral part of it.

2.2 The athlete or visitor must adhere to the regulations and house rules established by Tatsushin and declares that he/she will comply with these regulations and rules.

2.3 Any act, omission or behavior of an athlete or visitor that is contrary to one or more provisions of these terms and conditions, the regulations and rules, or other actions that could damage the name and reputation of Tatsushin, Tatsushin and/or its representatives the right to immediately terminate the membership and deny the person in question access to the gym, without this giving the right to a refund of registration fee, entrance fee or membership fee.

2.4 The management reserves the right to refuse access to persons without giving reasons.

2.5 The rights arising from membership are strictly personal.

2.6 Tatsushin reserves the right to limit the total number of registrations, as well as to change the sports schedule, opening hours, closing times, membership and other rates.

2.7 Code of Honor: Fights only take place on the mat or in the ring, never on the street. The techniques you are taught should only be used in defense of yourself or others. You should never use your fighting techniques against someone who cannot defend themselves. Honor, loyalty and adherence to the code of honor are more important than any fighting technique, graduation or title.

Article 3 – Deductible and liability

3.1 The athlete trains at his own risk.

3.2 Every athlete or visitor is responsible for any damage to Tatsushin's property. If damage is found, the person who last used the item in question will be assumed to be responsible unless proven otherwise.

3.3 Clothing or other property left behind will be kept for one month. Thereafter, Tatsushin reserves the right to deal with it at its sole discretion.

3.4 The athlete hereby declares that he waives all rights to hold Tatsushin liable for costs, damage and/or injury resulting from an accident, or for the loss of clothing and objects left behind.

3.5 Tatsushin is not responsible for damage to or theft of vehicles or other means of transport of members parked on the Tatsushin site. Tatsushin is also not responsible for damage, loss of property or physical injury that may occur to an athlete or visitor before, during or after use of the facilities.

3.6 It is the athlete's obligation to report any health risks that limit participation in a responsible manner to the trainer prior to training.

Article 4 – Membership and payment

4.1. When taking out a membership, there is no registration fee, but you are expected to purchase a Tatsushin active dry shirt (available in our store) and wear it during the training sessions. In order to guarantee unity and equality on the mat. The normal term starts on the 1st of the month. The first payment is made at the start of membership, which may involve a partial payment. You will then be charged a payment every month. The contribution is paid in advance via direct debit approved by the athlete. This collection takes place for a period of 3 months. After this term, the membership is tacitly automatically extended by 1 month.

4.2. The athlete is responsible for the smooth payment of monthly or annual contributions and other amounts owed to Tatsushin.

4.3. If the monthly contribution or other amounts cannot be collected, an administration fee of €5 per month will be charged.

4.4. If the amount due after a reminder has not been paid to Tatsushin within 30 days of the date, Tatsushin will transfer the claim to a collection agency that will collect on Tatsushin's behalf. The costs of this, including 15% extrajudicial collection costs, are borne by the member. The member already agrees to pay these collection costs as a reward for the collection agency's work, which has become necessary due to the member's behavior. In addition, the member must pay the statutory interest from the date on which the amount is due, as well as €5 in postage and administration costs.

4.5. After the term in the reminder has expired, all installments that have already expired and are yet to expire become immediately due and payable if payment is not made. In these cases, Tatsushin reserves the right to deny the member in question the use of the facilities.

4.6. Disputes will be submitted exclusively to the competent court within the district where Tatsushin is located or, at the discretion of Tatsushin, to the competent court within the district where the member has his/her place of residence.

4.7. Absence of the athlete, for whatever reason, does not release the athlete from the obligation to pay the due contribution and does not entitle the athlete to any reduction in the contribution, unless Tatsushin has released the athlete from this obligation in advance.

4.8. Tatsushin reserves the right to index the monthly contribution prices annually.

4.9. No rights can be derived from promotions or special offers, either in advance or afterwards.

4.10. Upon cancellation, the current membership will expire.

4.11. When re-registering, a €25 registration fee must be paid.

4.12. If errors have been made by members or Tatsushin where an outstanding membership fee is still due, the member must still pay this retroactively at the next monthly payment.

4.13. When taking personal training, you must unsubscribe from the training in question 24 hours in advance. If this does not happen, Tatsushin will still charge for the lesson.

4.14. It is not possible to save tickets. So use your ticket before the end of the week. Catching up on lessons is only possible in consultation with a valid reason or in the event of unforeseen circumstances.

Article 5 - Duration, breaks and termination

5.1 Tatsushin membership remains valid for the agreed minimum period upon registration and can only be terminated by cancellation after that period has expired.

5.2 Tatsushin uses contracts of 3 months and 1 year, which are tacitly extended by one month after expiry.

5.3 Exceptions are those who have opted for a 10-visit membership. There are no registration fees for this membership and it is valid for one year.

5.4 When a youth member reaches the age of 11 or 16, his/her membership will be adjusted to the membership of the relevant age category, whereby the duration of a previously concluded membership is retained.

5.5 During the membership month it is only possible to change the membership by upgrading to a higher membership. Please take into account a processing time of 1 month.

5.6 Membership can only be terminated on the last day of a month, with a notice period of at least one month. This means that if you cancel in month X, the membership will end at the end of the following month.

5.7 You can cancel your membership if you have purchased a subscription via eversports yourself, go to: Profile - My products and memberships via the eversports app. Or send an email to info@tatsushin.nl Please take into account a notice period of 1 calendar month. You will receive a confirmation of cancellation and the end date of your membership by email.

5.8 Memberships cannot be temporarily paused for short illness, short vacation or other reasons lasting less than 60 days (holiday stops are already included in the membership fee).

5.9 Memberships can only be paused temporarily (minimum 60 days to maximum 160 days) in the event of illness, injury or a long trip.

5.10 If a membership is temporarily terminated, the duration of the membership is automatically extended by at least one month.

Article 6 - Public holidays, vacations, competitions, tournaments and demonstrations

6.1 Tatsushin has the right to close all or part of the day and/or to adjust the sports schedule on recognized public holidays and/or during (school) holidays.

6.2 During holidays, sports activities are canceled for a maximum of four weeks. This period will be charged, because the stop has been included and settled in our contribution calculation. The athlete is not entitled to a refund of this contribution amount for this period, unless otherwise determined by Tatsushin management. It is not possible to catch up on missed sports time during these periods.

6.3 Tatsushin reserves the right to use or allow the use of the entire gym or part of it for events such as competitions, tournaments, demonstrations, celebrations, etc.

Article 7 – Personal data and images

7.1 The personal data of the members will be treated strictly confidential and will only be used for Tatsushin's administrative purposes. This data is never made available to third parties for commercial purposes.

7.2 Information about sports times and other activities of Tatsushin is communicated via e-mail, flyers or information boards in the gym, the website and social media.

7.3 Image material can be used for promotional purposes. If a member objects to the use of his or her images, this must be explicitly indicated in advance to the trainer and/or image maker.

Article 8 – Clothing and appearance

8.1 Tatsushin determines the requirements that the sportswear must meet, including a Tatsushin active dry shirt, bandages and gloves. Trousers without buttons and/or zippers. Other sportswear is not permitted. The athlete is responsible for purchasing the necessary clothing.

8.2 Wearing sportswear is mandatory. It is not permitted to exercise with your upper body bare.

8.3 Wearing worn, torn, unsavory clothing or clothing with offensive, insulting, discriminatory or inflammatory texts and/or images is not permitted. This also includes all football shirts.

8.4 It is not permitted to wear jewelry and piercings during sporting activities. If they cannot be removed, they must be taped.

8.5 Nails must be cut short at all times.

8.6 Tattoos with offensive, insulting, discriminatory and/or inflammatory texts and/or images must be covered while in the gym.

8.7 Long hair must be tied back.

8.8 Existing wounds and wounds arising during class must be dressed.

8.9 You enter the mat with bare feet.

8.10 During training, everyone wears sufficient protective equipment to prevent injury.

8.11 The use of poorly maintained and/or unsafe materials and aids is prohibited, both for the organization and for the athlete.

Article 9 – Smoking and prohibited substances

9.1 Tatsushin is a non-smoking gym. This applies both inside and outside the gym.

9.2 The use of drugs, alcohol and performance enhancing substances is prohibited, both inside and around the gym.

9.3 In the event of possession, use or trade in any of the aforementioned prohibited substances, Tatsushin reserves the right to immediately terminate the contract/membership and permanently deny access.

Article 10 – Children and pets

10.1 Children under the age of 11 who are not currently exercising at Tatsushin may only stay in and around the sports area under the supervision of an adult. They may not use the sports area as a playground unless permission has been requested and obtained.

10.2 Pets are not allowed at Tatsushin unless permission has been requested and obtained.
